Hi, I'm RonBot, a script that checks new non-free file uploads. I have found that the subject image that you recently uploaded was more than 5% in excess of the Non-free content guideline size of 100,000 pixels. I have tagged the image for a standard reduction, which (for jpg/gif/png/svg files) normally happens within a day. Please check the reduced image, and make sure that the image is not excessively corrupted. Other files will be added to Category:Wikipedia non-free file size reduction requests for manual processing. There is a full seven-day period before the original oversized image will be hidden; during that time you might want to consider editing the original image yourself (perhaps an initial crop to allow a smaller reduction or none at all). A formula for calculation the desired size can be found at WP:Image resolution, along with instructions on how to tag the image in the rare cases that it requires an oversized image (typically about 0.2% of non-free uploads are tagged as necessarily oversized). Please stop. You uploaded File:Jason-Kenney.jpg but forgot to specify the source or the license. This information is required, it's not optional. You then replaced an existing freely-licensed image with this new image. You falsely claimed the image was public domain because it was created by the Alberta government. Alberta government works are covered by crown copyright and are not public domain.   1. Crown copyright (in Canada) differs from regular copyright in one important regard. Please tell me how it differs.

It is not automatically part of the public domain.

  1. What if any circumstances would we prefer to use a copyrighted image of a person under a claim of fair use, instead of a freely licensed image of them? I'm not trying to mislead you; there may be a case where this would be acceptable here at Wikipedia, or there might not be a case.

If the photo is of a deceased person and is used as the main means of identification for the article it would qualify for Fair Use.

  1. When you upload an image in the future (any image, whether you took the picture or you found it on the Internet), will you commit to providing both the source and the license information immediately upon upload?

Your answer to crown copyright is not accurate. Please note that I'm looking for you to answer how crown copyright differs from regular copyright. Your answer to the second question is incorrect because I wasn't clear. Assume you have a public domain image of a deceased person and you have a slightly better but copyrighted image of that person. Could you use the copyrighted image? Again, the block is not punitive. It's okay that you didn't get this on your first try, we are still engaging in discussion toward getting you unblocked. Your answers weren't monumentally incorrect or anything, and copyright and fair-use is notoriously tricky. Crown copyright expires 50 years after publication while regular copyright expires 50 years after the death of the creator. I'm afraid both of these answers are incorrect. I won't penalise you for the first as at least one Canadian government site gives the wrong information. Crown_copyright#Canada gives the correct information. For the second answer, though, that's just outright incorrect. Please reread WP:COPYRIGHT and WP:FAIRUSE. Sorry, but I do not see how this is 'entirely false'. On Wikipedia:FAIRUSE it states "Some non-free images may be used on Wikipedia, providing they meet both the legal criteria for fair use, and Wikipedia's own guidelines for non-free content... [such as] Images that are themselves subject of commentary".

Perhaps I should clarify what I mean. I believe, under the aforementioned prescription, if there was a particularly notable photo of Barack Obama, it would be allowed to use that photo on the Wikipedia page which discusses the photo. Similar to how the photo Taking a Stand in Baton Rouge is featured on its own article, despite being produced by a photographer working for Reuters.--AristarchusValen (talk) 00:27, 16 May 2019 (UTC)[reply]

Ok. You should therefore not use the copyrighted image even it is slightly better.
