Not to be confused with John Quincy Smith (1824-1901) "Smith, John Quincy (1824-1901) — also known as John Q. Smith — of Oakland, Clinton County, Ohio. Born near Waynesville, Warren County, Ohio, November 5, 1824. Republican. Member of Ohio state senate 5th District, 1860-61, 1872-73; member of Ohio state house of representatives from Clinton County, 1862-63; U.S. Representative from Ohio 3rd District, 1873-75; defeated, 1874; U.S. Commissioner of Indian Affairs, 1875-77; U.S. Consul General in Montreal, 1878-82. Died in Oakland, Clinton County, Ohio, December 30, 1901 (age 77 years, 55 days). Interment at Miami Cemetery, Waynesville, Ohio."[1][2]

James Q. Smith was a judge in Alabama. He ran for U.S. Congress against Charles M. Shelley in a troubled election.[1]

He served as a District Attorney. As a circuit judge in Alabama, he ordered governor Smith's removal from office. He was an lly of Busteed.[2]
