Sorry to be such a bore, but, if the author died in 1941, this isn't public domain until January 1 next year (see Wikipedia:PD#When does copyright expire?). There are a couple of ways around this- we could delete the image but add it to the category, so that the image will be undeleted then. Alternatively, you mention "von Tavel's publication was 1886; Bary 1884". If this picture was/these pictures were first published in one or both of those books, and the books were first published in the US, the image can be tagged on Commons with Commons:Template:PD-US. Even if they weren't first published in the US, but the picture(s) was/were first published in one or both of those books, the image could be moved here, to the English Wikipedia, tagged with Template:PD-US-1923-abroad and added to the category on Commons. Milburn, you're such a stickler! Hmmm, both the von Tavel and de Bary books were published in Germany. I think I'll just remove the image for now, and reinsert in January 2012. I'll find a temporary replacement at MO, or perhaps I can whip up something suitable using my own collection. Sasata (talk) 15:23, 31 August 2011 (UTC)[reply]

I've nominated it for deletion at Commons. Sorry, this whole thing leaves something of a bitter taste in my mouth- it feels like a horrendous waste of time, especially as the Commons deletion process is so slow anyway.
