Fair use is {{tv-screenshot}}, but it is being used in College football, Bevo (mascot), NCAA Division I-A national football championship, Trophy, 2005 Texas Longhorn football team, User:Johntex/Gallery01, College football on television, User talk:Scm83x/archive1, and 2005 NCAA Division I-A football season. Basically, it is being used for everything other than "for identification and critical commentary on the station ID or program and its contents" and, as such, could not be considered fair use. My original intention was to use the image as an indication of how the media presented information on the BCS championship and its corresponding trophy. However, the broadcast was equally a commentary on the Texas Longhorns chances of winning that championship - which they did in fact win. Therefore, I think it is entirely fitting for those articles. It happens that our information on that event is spread out over several articles. The photo does not appear in all those articles, just some of them. The addition to college football on television is more recent but certainly fitting. I agree the image should not be in the User space. I will link-image it in those two locations. In short, there is a need to tidy up usage here, but there is not a need to delete this image. Thank you , Johntex\talk 01:14, 28 June 2006 (UTC)[reply]
I have now removed the image from the User pages and tightened up the wording in each of the other articles to ensure the picture is well referrenced. I would like to remind everyone that this is a single frame of a 3 hour broadcast and is a degraded image by virtue of it being a photo taken of a television. Followup: Johntex and I have discussed the use of this image some on my talk page and his talk page. We feel that a smaller version of the image would probably be ok on college football on television and thus, it probably should not be deleted outright. Would another user with experience in image copyright issues be willing to examine the other uses and offer an opinion as to whether those uses constitute fair use?         • I don't know about derivative works in general, but cropping an image to show only the relevant part probably strengthens a claim of fair use. It's like using only a phrase or a sentence from a book rather than an entire chapter, or using a 30-second clip of a song rather than the whole thing. The third factor to be considered when evaluating a fair-use claim is "the amount and substantiality of the portion used in relation to the copyrighted work as a whole" (see Wikipedia:Fair use), so using a small portion of the copyrighted work is better than using the whole thing. —Bkell (talk) 00:43, 1 July 2006 (UTC)[reply]

The {Art} tag requires the use of the image "for critical commentary on"
  • "the work in question,
  • "the artistic genre or technique of the work of art or
  • "the school to which the artist belongs"
