Comment: @HouseBlaster: I never claimed it was public domain, I explicitly said it is not PD (the content is owned by Connecticut). And I used a fair use rationale, NOT a PD-upload rationale. I don't see a proper evaluation of my request, as you have treated it as a PD request, when it is a NFC-FUR upload request instead. Further, non-PD content that is owned such as CC-content is uploaded to WMF servers, so, non-PD content can be uploaded. The no-derivatives,non-commercial restriction is not applied to Connecticut imagery per the linked to legal opinions provided, as it can be used commercially and can be used without restriction. That does not mean it is PD, that does mean it can be used in ways that result in derivative imagery and commercial purposes. The damage to the sub has been cosmetically repaired, so the state of the damage to the sub is what this image illustrates, for which a new photo cannot be created, since it has been cosmetically repaired. -- 67.70.25.80 (talk) 04:36, 28 July 2023 (UTC)

Ah, I believe I was confused by the link to the information on CT content. When using NFC, the ability to make derivative works or use the work commercially is not considered. I have gone ahead and uploaded the image, as I agree that this meets the NFCC. It is at File:Deepsea Challenger with fire damage.jpeg. House Blaster^talk 22:36, 28 July 2023 (UTC)
