If you have not created this media yourself then there needs to be an argument why we have the right to use the media on Wikipedia (see copyright tagging below). If you have not created the media yourself then it needs to be specified where it was found, i.e., in most cases link to the website where it was taken from, and the terms of use for content from that page.

If the media also doesn't have a copyright tag then one should be added. If you created/took the picture, audio, or video then the {{GFDL-self}} tag can be used to release it under the GFDL. You have included detailed licensing information about the image, which is very good, and we definitely need that. But that's not a fair use rationale; that's the original licensing information. See Wikipedia:Image description page for what a fair use rationale is.

Given their (strange) licensing statements, I actually wonder if there is a chance that they would release this image under a free license. This is probably worth looking into. Jkelly 18:12, 3 August 2006 (UTC)[reply]

That's exactly the confusing part. If they are not copyrighted, how can that website impose its licensing upon it? Should we believe the statement that it is not copyrighted, or should we believe the statement that the image needs permission and licensing to be used? I think that the best way forward is to email them and ask for clarification, especially since it doesn't make sense to claim "fair use" on an image that we could make ourselves and isn't particularly special in any way. That's up to you. You can write a fair use rationale, which will likely prevent the image from being deleted. If I were you, however, I'd rather start the conversation without it being obvious that we're already republishing the image without their permission. Your call.
