Going Public

[edit]

Hey KP, had a look at your edits - they look sweet. Gonna slim down the history of CLH a lot as it's quite bloated. Have kept a copy of all the data in case we want to add it back in tho. 3D Gaius (talk) — Preceding unsigned comment added by 3D Gaius (talkcontribs) 16:58, 17 October 2020 (UTC)[reply]

Great! I think you're right about the history - it is very bloated. Don't worry about keeping the data - all our old versions are available in the page's history. Kohlrabi Pickle (talk) 01:12, 18 October 2020 (UTC)[reply]
3D Gaius, I've gone through the page and you've done a swell job with the copyediting! It looks so much neater and more readable now. I've done some minor editing for grammar, punctuation, style, etc and added in some wikilinks (meaning links like these.) I think what we have is ready to be moved into mainspace, with the incomplete stuff to be added later.
Re the conference material you shared - that's a massive trove and clearly very helpful. It will take time and energy to process though, because it's all in video form. I think we should proceed with our plan to move stuff into mainspace soon, and then supplement it with the video material as and when we're able to process it. What we've done so far is not exhaustive by any means anyway; we've still got Professor Sharafi's material, for example... Kohlrabi Pickle (talk) 03:09, 18 October 2020 (UTC)[reply]

Creating a new page

[edit]

Hey A - if there's stuff we want to change but don't want to get into edit conflicts, we can make notes here. Kohlrabi Pickle (talk) 09:08, 6 September 2020 (UTC)[reply]

Cool! I'll just need to get the hang of this editing malarky first... — Preceding unsigned comment added by DJAccursius (talkcontribs) 12:31, 8 September 2020 (UTC)[reply]

Yo A, made a new account as I couldn't for the life of me work out what the old one's password was. I've been thinking: maybe it would be a productive avenue to organise and present groups which uncontroversially regard themselves as 'doing Comparative Legal History'? We might get bogged down a bit working out exactly what constitutes the discipline - if our goal is to 'crystallise' the subject then providing a roadmap to 'what's up' could be good for young researchers. 3D Gaius (talk) 21:41, 23 September 2020 (UTC)3D Gaius[reply]
Yo 3D Gaius – that's a good idea. We can try that. I'm concerned though that we'll have trouble finding a common thread that links them all. Kohlrabi Pickle (talk) 03:24, 26 September 2020 (UTC)[reply]
[edit]

DJAccursius, I'm finding it difficult to locate comparative legal history in other cultures and time periods. From what I can see, where there is legal pluralism, there is legal comparison. But comparative legal history requires another dimension - comparing legal systems across time. So far I haven't lucked out on anything that says that... Kohlrabi Pickle (talk) 03:50, 9 September 2020 (UTC)[reply]

Hmm, a problem. We might have to conclude that as a separate discpline it has only emerged recently, though elements of what constitutes 'CLH' can be found in various other discplines throughout time. I mean, modern legal history as we know it isn't even that old! 3D Gaius (talk) 21:42, 23 September 2020 (UTC) 3D Gaius[reply]
Yes, true. This is tied up with the definition question. We can have a chat about that. Kohlrabi Pickle (talk) 03:24, 26 September 2020 (UTC)[reply]
Surprisingly, I've just discovered that Ancient Law by Henry Maine does a comparison of ancient Hindu law and the Roman law of property (and probably other things too). I'm surprised that it hasn't popped up in any of the articles I've read so far. Ibbetson mentions it, but merely as a reference to Maine's methodology. Material I can't access

[edit]

DJAccursius,

  • there's what seems to be an excellent book that I can't access because it's a legal deposit... I might have to leave reading and incorporating that one to you. Or alternatively, if you can find a way to get hold of it and share the important chapters, I'm happy to split the reading with you. This is the book: [1].
  • Also, just putting a note here for you to ask Ibbetson about the Comparative Legal History of the Ancient World project. If you're tied up at the moment, I could write to ask him too, but I wonder if that will confuse him. XD Kohlrabi Pickle (talk) 05:44, 12 September 2020 (UTC)[reply]
Gotcha - I'll have a look as I'm going back in a week or so. I can do some of the physical reading in the UL! 3D Gaius (talk) 21:43, 23 September 2020 (UTC) 3D Gaius[reply]
Superb! Kohlrabi Pickle (talk) 03:24, 26 September 2020 (UTC)[reply]

Useful/important material

[edit]
  • Reading lists as suggested by Professor Sharafi: [2]. Seems thoroughly academic, and I'm slightly concerned that we'll have to draw out conclusions on our own, which may fall foul of WP:NOR. Who knows, though - it could be fodder for a legal article, which we can then expand the Wikipedia page off of. Kohlrabi Pickle (talk) 05:46, 12 September 2020 (UTC)[reply]
Interesting! What kind of article would you be thinking? Maybe the emergence of a new discipline? Or more substantive stuff? 3D Gaius (talk) 21:45, 23 September 2020 (UTC) 3D Gaius[reply]
It's not clear in my head yet... I'm seeing potential in legal articles for filling in the gaps we're finding. The reading list she's suggested would probably involve some substantive comparisons; building a basic block of legal-historical comparison in South Asia. Helpfully, Professor Sharafi advocates comparisons that go beyond national borders. This could be an interesting complement to the European comparative legal history project, preventing it from falling into the same myopia as national legal histories.
