The Sullivan case material you quoted is old, old material that has bounced around on the internet. The judge in that case was incorrect, and his statement was not a ruling. This was an excerpt from a transcript during a hearing. Judges (and others) say incorrect things during hearings all the time. Indeed, that's why court transcripts are not generally considered proper sources in Wikipedia. Witnesses lie, judges make mistakes, etc.

I was once sitting in federal court during a hearing where the judge stated that he thought that when a certified public accountant signs a federal tax return, it means that the CPA has audited the tax return. (That's blatantly incorrect.) But the judge's statement was not a ruling. It was a comment he made during a hearing.

What counts is the court's ruling in a case. No court has ever ruled that the Sixteenth Amendment was not properly ratified. Every single court that has decided the issue has rejected the goofy theory that the Amendment was not properly ratified.

The old "Sixteenth Amendment was not properly ratified" nonsense is part of a tax scam that began about sixty years after the Amendment was ratified. The earliest reported court case on this nonsense is from 1975, which was sixty-two years after the ratification. Famspear (talk) 18:03, 23 May 2013 (UTC)[reply]
