Technicality

Please be careful with copyright issues

I notice you have been altering image copyright tags. This is a complex area, so you might want to spend some more time here before delving into it. Specifically, the US NARA cannot release other people's copyrights. The fact that an image is available from NARA does not mean that it is not copyrighted. The email from NARA is incorrect. The statute on US government works being public domain is very specific. "A “work of the United States Government” is a work prepared by an officer or employee of the United States Government as part of that person’s official duties." It does not include works "accumulated" by the US government. That's overreaching by NARA. Also, the court cases you linked to relate to ownership of a tangible object, not the intellectual property rights underlying the work. In light of the clear and unambiguous language of the statute, the NARA's position is indefensible, in addition to being self-serving. Again, you are confusing ownership of an image with ownership of the copyright in that image. Just because the US owns the images and documents does not mean that the US owns the copyrights underlying them. Anyway, this image does not have to be deleted, because it can be used in at least the subject's article pursuant to Wikipedia's non-free content policy. But if there are other images you feel should be deleted, please give me the names and I'd be happy to check on them for you. Thanks! -- But|seriously|folks  02:43, 18 October 2007 (UTC)
