In her appeal, Harris argued that Norsworthy's surgery was medically unnecessary. Contrary to the personal testimony of Norsworthy and the findings of Norsworthy’s psychologist Dr Reese[1], Harris contended that “Norsworthy has not demonstrated that SRS is medically necessary at the present time, because she has not shown that she will suffer severe emotional distress or resort to self-mutilative behavior if she is denied SRS”.[2] In the appeal, Harris also argued that, “the hormone therapy and mental health treatment provided by CDCR since 2000 has alleviated Norsworthy’s distress, and that she is not entitled to ‘any particular type of treatment’ for her gender dysphoria”. [3]
Despite her role in the Norsworthy case, Kamala Harris maintains her reputation as a champion of LGBT rights[4]
After California failed to fully implement the court's order to reduce crowding, and was ordered to implement new parole programs, lawyers for Kamala Harris appealed the decision on grounds that if forced to release these inmates early, prisons would lose an important labor pool[5]
