Workplace violations are violations of labor rights, employment laws, the Fair Labor Standards Act. human rights laws or other happening at the workplace.
Among the most frequent violations from the side of the employer in the US are:[1][2][3]
- Unpaid compensable time / unpaid work
- Employer intimidation
- Unpaid vacation time
- "Use It or Lose It" vacation time
- Unpaid commission or bonus
- Misclassification as exempt employees
- Misclassification as an independent contractor
- Unpaid or improperly calculated overtime pay
- Comp time instead of overtime pay
- Force false reporting of overtime work
- Minimum wage violations
A generic violation complementary to the different types of time theft mentioned above is wage theft or any illegal wage gap.
Among the violations that may also be inflicted by employees onto each other are
- Misconduct
- Workplace harassment or even violence
- Safety violations
- Stealing
Similar to factors of hostile work environments, such violations can cause pressure and occupational stress that is usually correlated with decreasing efficiency.[4][5][6][7] Thus, while unethical or illegal behaviours from the side of the company or the employer can help reduce costs, in the long run they may turn out economically adverse.
