Introduction
[edit]The words THALAPPAKATTI and BRIYANI are inseparable. In the same way 'THALAPPAKATTI' and its 'TRADEMARKS' are also inseparable.
When Dindigul Thalappakatti Briyani is popular and well-known throughout Tamil Nadu and beyond, some rivals tried to counterfeit / copy the mark Thalappakatti and started using Thalappakattu Briyani with many prefix and suffixes. When Dindigul Thalappakatti wanted to open their branches in Chennai, there were many rivals who were using / copying the Popular mark Thalappakatti.
Trademarks and Thalappakatti
[edit]In the year 2005, Dindigul Thalappakatti have filed their Trademark applications and before that the rivals who are passing off the original Thalappakatti mark have filed their trademark applications in the year 2004 after the publication of an article in the Tamil Magazine 'KUNGUMAM' in which Mr. Dindigul Leoni, who is famous for his 'Pattimandram' would have spoken about the Dindigul Thalappakatti Briyani and his relationship with with the Thalappakatti Briyani from his childhood.
Dindigul Thalappakatti established its Rights over the Trademark THALAPPAKATTI before the Trademarks Registry, Chennai which is the registering authority of the Trademarks in India, before the IPAB (Intellectual Property Appellate Board), Hon'ble High Court, Madras and even before the Hon'ble Supreme Court of India. By the continuous and consistent efforts of Dindigul Thalappakatti through Mr. N. Dhanabalan, son of Mr. Nagasamy who was fondly known as Thalappakatti Naidu and then by Mr. Nagasamy Dhanabalan (Grandson) the valuable rights of Dindigul Thalappakatti in the mark THALAPPAKATTI were established. Now, the mark 'THALAPPAKATTI' and its associated marks are owned by Dindigul Thalappakatti Briyani family.
Dindigul Thalappakatti got its first Trademark Registration in Sep 2010 for the mark 'THALAPPAKATTI BRIYANI HOTEL' after battling with the counterfeiting rivals and establishing their long, continuous and prior use of the mark. They got their Second Registration in Aug 2014 for the mark THALAPPAKATTI. After that Dindigul Thalappakatti has filed many Trademarks and got them Registered. They are protecting their IP Rights (Intellectual Property Rights) by sending Cease and Desist Notices, by filing Oppositions and contesting in the Opposition proceedings etc.
Dindigul Thalappakatti has successfully maintained the distinctiveness , uniqueness and purity of the mark by successfully preventing the deceptively similar marks like Thalappakattu, Thalappakettu etc. with prefix and suffixes from being used and registered. Even the mark Chennai Thalappakatti by a rival was Opposed and abandoned. By the effective legal actions, Dindigul Thalappakatti is maintaining that all the rival marks were either abandoned or refused.
Apart from India, Dindigul Thalappakatti has Registered their Trademarks in many other countries.
