Divulgation is not exactly the same as "publication". Divulgation is either publication of performance or... all kinds of ways to make a work available to the public. Generally, in Berne countries, performance does not constitute a publication.
Berne Convention, article 3 (3) : "The performance of a dramatic, dramatico-musical, cinematographic or musical work, the public recitation of a literary work, the communication by wire or the broadcasting of literary or artistic works, the exhibition of a work of art and the construction of a work of architecture shall not constitute publication."
But all this constitutes a divulgation for the purposes of French law.

- True. Changed to "made available to the public". Alternatively, we could use "divulging" with a footnote explaining the difference to the legal meaning of "publication". Lupo 13:28, 3 December 2008 (UTC)
