Saying that Scalia and Thomas are opposed to prophylactic rules needs a bit of a qualification—if the exclusionary rule is considered one (as it often is), they have been strongly in favor, for example semi-recently in Kyllo to exclude evidence obtained in violation of the 5th Amendment. --Delirium (talk) 04:53, 2 June 2009 (UTC)[reply]
