Only Transco can own the national grid
[edit]Articles 419 and 420 of the Philippine civil code clearly require that the National Transmission Corporation is the only permitted owner of the National Grid. Article 419. Property is either of public dominion or of private ownership. Article 420 continues The following things are property of public dominion:
(1) Those intended for public use, such as roads, canals, rivers, torrents, ports and bridges constructed by the State, banks, shores, roadsteads, and others of similar character;
(2) Those which belong to the State, without being for public use, and are intended for some public service or for the development of the national wealth. R. A. 9136, CHAPTER II, Organization And Operation Of The Electric Power Industry, SEC 8, states: “The TransCo may exercise the power of eminent domain subject to the requirements of the Constitution and existing laws.
