RfC: should Category:Disbarred attorneys be linked to Category:Criminals via a see also reference

I posted an RfC at Wikipedia:Requests for comment/Society, law, and sex as to whether the Category:Disbarred attorneys should be linked to Category:Criminals via a see also reference. What about Clarence Darrow ?

Following his defence of The_McNamara_Brothers, Clarence Darrow was charged with jury tampering. The first trial resulted in an acquittal; at the second the jury could not agree. It appears that, in exchange for the prosecution's agreeing not to proceed with a retrial, Darrow promise never again to practise law in California. Is this not, effectively, a disbarment? He was never admitted to the California Bar. He probably practiced there pro hac vice.

Name of article

I suggest that the name of this article be changed to "Disbarred lawyers". Strictly speaking, the current list should exclude English barristers who are most certainly not attorneys. They would be disbarred if they acted as such.Cutler 10:25, 26 August 2007 (UTC)

Is this a good idea?

As a lawyer myself (if not in the US), I'm somewhat uncomfortable with this list. I suggest we restrict it to disbarred attorneys that were notable beyond their profession (eg, US Presidents, legislators) and add a corresponding column. Otherwise, it's a magnet for legal trouble for Wikipedia - every disgruntled fool can add an attorney to the list, who then can sue Wikipedia for defamation before (or even if) it tis reverted. Maybe a category would do, too? Sandstein 06:46, 26 March 2006 (UTC)

Wikipedia already has notability criteria in place (see Wikipedia:Notability) which should satisfy your objections. This article is not a list of all disbarred attorneys, but rather of notable attorneys who have been disbarred, or attorneys whose disbarment is in and of itself notable (e.g., where it establishes a precedent, or where it led to public controversy). Rest assured that no one will be listing Joe Blow, Esq. of Podunk, who was disbarred for one month in 1973 for failing to pay his professional association dues. —Psychonaut 04:38, 31 March 2006 (UTC)

I have removed Lewis Libby from the list as of this moment since he is not disbarred (despite recommendations from the bench pending expiration of appeals, etc). MrBill66 14:10, 6 December 2007 (UTC)

Quick question

If this is a page for dis-barred attorneys, and Clinton wasn't dis-barred (suspended as the page says) then why is he on a page for dis-barred attorneys? —The preceding unsigned comment was added by Ghostalker (talkcontribs) 06:07, 17 January 2007 (UTC).

I agree. Stating that Clinton was disbarred in either case is inaccurate at best. JavaGuy 14:58, 18 June 2007 (UTC)

He was not. He was suspended by the Arkansas bar (the second article you linked is about how they first wanted to disbar him, but eventually they just suspended him after that article was published), and he resigned from the Supreme Court rather than risk being disbarred. 84.197.91.247 (talk) 23:08, 9 July 2008 (UTC)

Other nominees

If this list is to be filled out with "notable" disbarments (not just anonymous lawyers who raided client trust accounts), I would add Richard Nixon since he was disbarred by the State of New York (they refused to let him resign his license in lieu of disbarrment without an admission of wrondoing for his role in the Watergate scandal). I would also add controversial activist Jack Thompson since his legal claims were known for their notoriety.
