I think that the claim that the term was coined so recently is clearly erroneous, and I would suggest that its broader use needs to be acknowledged, even while keeping the focus on this particular use of the term.Wbehun (talk) 04:42, 8 November 2010 (UTC)[reply]

I agree. For instance, Randy Barnett has used the term to describe a sort of blending of legal positivism and natural law theory. See here, which was published in 1978, whereas Olufemi Taiwo's book appears to have been published originally in 1996. Orthzar (talk) 19:48, 15 December 2012 (UTC)[reply]
