History of Romanian Penal Code
The new Romanian penal code of 1864 did NOT criminalized homosexuality because it was based on French penal code of 1810. This code was imposed to Moldova in 1919 (before that, old Russian Art. 516 banned homosexuality). Only Transylvania (old Hungarian Art. 242 PC) and Bucovina (old Austrian Art. 129) still banned homosexuality. Both regions were annexed to Romania after the war, so Romania created new national penal code in 1936. This code (as result of public debate on sexuality) banned PUBLIC homosexuality only (Article 431 penalized "acts of sexual inversion committed between men or between women, if provoking public scandal"). In 1948, this "public" homosexuality was considerate by court, that it include all situations whatever public or private if "provoking scandal", thus homosexuality became de facto illegal. However, not until 1968, the new penal code was passed making homosexuality illegal official. This law was repealed in 1996, however new article 200 back to its old version and banned again "public" homosexuality only. This Article 200 was repealed in 2002.

Short question
[edit]“There are currently no laws against gay citizens in Romania, aside from those that deny equality in marriage.”
- I have this short question regarding this section of text: As I know it isn't required to prove your sexual orientation when you marry someone. So aren't gay people equal in right with straight people when talking about marriage? They both have the same right to marry some of opposed sex and are not allowed to marry someone of same sex. Maybe a straight person wants to marry someone of same sex and s/he isn't allowed to do so, thus being discriminated from the rest who don't desire such a thing. And what I want to demonstrate is that sexual orientation, sexuality, the love for someone is purely subjective. I don't know if someone here studied law, but this is not discrimination. So I suggest that a more appropriate way to say the sentence mentioned above is: “There is no low for marriage to suite the needs of those who want to marry a same-sex person”. Perfectly objective. Who said same-sex marriage is just for gay people. As long as law doesn't ban it, it should be for everyone.

Opinion not fact
[edit]This portion of the opening statement would appear to go against Wikipedia guidelines
In turn the views held by the Romanian people are not the fault of the Romanian people but rather a lack of education due to the country’s unfortunate circumstances.
