Discrimination laws

[edit]

Am I reading this right? Gays/lesbians can get married, but they could still be fired for being gay? Seems a little odd. 174.58.137.241 (talk) 06:59, 17 July 2010 (UTC)[reply]

It's very unlikely since some other laws might be interpreted as banning discrimination based on sexual orientation. But current legal system does not explicitly include this type of ban, so the entries are correct unless proven otherwise.--Ąžuolas (talk) 18:54, 17 July 2010 (UTC)[reply]

The antidiscrimination law is there: http://www.infoleg.gov.ar/infolegInternet/anexos/20000-24999/20465/texact.htm but I am not qualified to decide if it covers the area of employment and provision of goods and services.--Ąžuolas (talk) 18:18, 15 August 2010 (UTC)[reply]

Blood donation

[edit]

I think the “yes” mark on the summary table where it says “MSMs allowed to donate blood” is extremely misleading. It would be more appropriate to mark it as a “no” instead. Looking at the references, men are only allowed to donate blood after one year of no sexual contact with men, while the same –obviously- is not applied for men who engage in heterosexual sex. So in fact, for instance, a gay man in a stable relationship can never donate blood. The sense of marking “yes” in to show the advances on those camps. Therefore, the green marking is misleading. Done. Ron 1987 06:08, 23 January 2011 (UTC)
To Jetstreamer given that you keep editing it: I don't know what is hard to understand about the ban, it is crystal clear: Men who have sex with men are not allowed to donate blood, (in the original norm "men who have or have had sex with men") no matter their marital status, their health or whatever. In practice, a married straight man CAN donate. A married gay man will NEVER be allowed to donate, not even to his husband, as the ban -12 month- establishes avoidance of factual contact, therefore being a perpetual ban. Leaving behind only those who are single and celibate for at least a year, something that is not asked to a straight man. Therefore the marker must be negative red –MEN WHO (CURRENTLY) HAVE SEX WITH MEN ARE NOT ALLOWED to DONATE. How can they donate? Only if they DO NOT HAVE SEX WITH MEN for at least a year. In fact is by renouncing to their sexuality altogether –no matter if the gay (or bi or trans) person is healthy, married, monogamous, not promiscuous, whatever- so is like saying: “as long as you do what defines your sexual orientation –no matter how safety and healthy- you are banned”.

Therefore you can not state that gays are allowed to donate while making the final reservation "are allowed if the renounce to sex for a year" Someone who does not understand that fact can see the green "yes" as a gained right -that's the point of the whole article- while in fact is a CONCEALED BAN. — Preceding unsigned comment added by Magnvss (talkcontribs) 01:05, 20 September 2011 (UTC) 3[reply]

I'm not discussing that point, I'm just pointing out that the legal right is wrong stated. Put a tick mark if the right reads “MSMs not allowed to donate blood” (yet this is not properly a right), or put a cross mark if the right reads “MSMs allowed to donate blood”. In its current version, the table expresses that MSMs can donate, as it denies that MSMs are NOT allowed to donate (hence, yes they can). Do you get it?--Jetstreamer (talk) 01:25, 20 September 2011 (UTC)[reply]
Yes, I get it. I took the right as the assertion instead of relying on the tick mark alone. I apologize, I confused this discussion with one I had before and I rushed up while trying to be clearer when in fact I was messing up with the premise.Magnvss (talk) 01:41, 20 September 2011 (UTC)[reply]
Glad we reached consensus. My request for an administrator help has been withdrawn. Warm regards.--Jetstreamer (talk) 01:46, 20 September 2011 (UTC)[reply]

Citation and Paraphrase Problem

[edit]

In the section, "Transgender rights and discrimination," there is no citation for the line:

"In 1997, Asociación de Lucha por la Identidad Travesti-Transsexual was created to defend the rights of transgender people. One of its first victories came in 2006 when the Supreme Court overturned a lower court's ruling that had stated that transgender people did not have a legal right to organize and campaign for their rights."

When looked more into on the web, I came across a source in which there is a line that is phrased exactly as it is in the article. The source is http://www.gutenberg.us/articles/gay_rights_in_argentina. I urge someone to verify the information above and change the phrasing so that it is not plagiarized. Dgenners (talk) 02:53, 3 February 2017 (UTC)[reply]

The source you mention copied the text from Wikipedia, and not the converse. No actions to be taken.--Jetstreamer Talk 12:49, 3 February 2017 (UTC)[reply]
