Image removal

First, thank you Mrathel for all the work you've done on this article.

At 16:59, 25 April 2009 I removed the image statement from the article with the comment "(Removed image. Image MAY be public domain in Sweden (doubtful) but is not in the US.)." See http://wiki.riteme.site/w/index.php?title=Gerontion&diff=286068993&oldid=286042497 Perusing the revision history I have just noticed that another submission was made just before I submitted my change. This made it look as if I was deleting all those changes too. I only intendend to delete the image statement (so there was an accidental change, not an improper change.) Fortunately my edit was almost immediately undone.

I'm now again going to try deleting the image (and only the image). I have since researched my claim that the picture is copyrighted and not usable on the Wikipedia website.

The picture was placed on the Wikimedia website with the claim that the picture was public domain in Sweden. The picture was claimed to be downloaded from http://nobelprize.org/nobel_prizes/literature/laureates/1948/eliot-bio.html , part of a website run by the Nobel Foundation. On the containing page for the wikimedia image there are a number of reasons given why the picture could qualify for public domain status. Since the picture is claimed to have been taken in 1948 it appears that the submitter figured that this was a picture taken by the press and the copyright protection time limit had elasped.

There are a number of reasons why this picture should not be used on Wikipedia:

1) The website that from which the picture was taken claims a copyright. Under the "Copyrights" section of the "term of use" webpage they say: "The following listed copyright protected material: photos of the Laureates, other photos, ..." See http://nobelprize.org/nobelweb/terms_use.html

The Salem Press, in a recent publication, has given the Nobel Foundation copyright credit for the photo. See an extract of the T.S. Eliot article of the publication with the credit at https://salempress.com/Store/pdfs/eliot.pdf

2) The picture of Eliot obviously was done by a professional portrait photographer and shows artistic creativity. It is not a photograph done by the press. For a press style photo showing Eliot at the Nobel ceremony see http://pro.corbis.com/search/Enlargement.aspx?CID=isg&mediauid={B506228F-DAEA-4F68-B3C4-84B3783A7AE1} (and the page with this photograph claims a copyright on this picture.) Although the uploader of the picture thinks this is a press picture a Swedish court would likely rule against it.

3) Just because a court in one country says the picture is public domain in that country doesn't mean that the picture is public in other countries. Images really aren't my area; if it is a violation, I have no problem with it being removed. but I am not sure everyone agrees with you.Mrathel (talk) 23:36, 25 April 2009 (UTC)[reply]
