Article name
[edit]Shouldn't this article be told "Scots law of delict" instead? It's odd to see an article called "Scots tort law" in which the first paragraph says that there is no such thing as Scots tort law. 145.116.236.110 00:35, 21 March 2007 (UTC)
This is a valid comment, tort does not exist in Scots Law —Preceding unsigned comment added by 80.43.149.38 (talk • contribs)
Moved; I trust parenthical disambiguation will be satisfactory. Alai 02:17, 13 April 2007 (UTC)
Mistake in scope of delict
[edit]Delict is not limited to breach of a duty of care - this being a subset of delict known as "negligence". Delict embraces a much wider range of civil liability, including assault, defamation, occupiers' liability, trespass and breach of privacy. —Preceding unsigned comment added by 82.41.235.35 (talk) 21:20, 17 November 2008 (UTC)
- Indeed. And three of the cases on duty of care are English (Bolton v Stone, Paris v Stepney Borough Council, Roe v Minister of Health) and so only indirect helpful in an article on Scots law. --Rumping (talk) 16:19, 29 June 2010 (UTC)
