Picture

[edit]

I have found several pictures of this vehicle here. I don't know if there are any fair use rules that would allow their use "as is", or if any of the pics are old enough to be in the public domain, but if not someone could try contacting the posters on that forum to see where they got them, but it's a French language forum and the posts are from 2006/2007, so I don't know how successful that approach would be. Here are some of the pics: [1] [2] [3] [4] [5] [6] [7] [8] Robman94 (talk) 15:59, 19 July 2011 (UTC)[reply]

I'm not a copyright expert. But I think that we are not able to copy images from other websites without knowing their copyright status. And of course in most cases they have been uploaded without anyone considering their copyright status. So ... if you want a wiki picture of a car, the best answer, in order to avoid the risk of a copyright breach, is that you really need to grab a camera, find a car, get the sun in the right place, and take a picture. However, there may be other ways for those with a deeper understanding than I of the international interplay of national copyright laws. If you want to try and contact a website owner and ask him about the copyright status of his images, I imagine you'll get the e-equivalent of a gallic shrug, but hey...I reserve the right to be wrong about that.
If you click on the website which I cite as a source, you can see there quite a lot of quite good pictures of the ... 171. That shows people how it looked. But if you try copying one to the wiki page someone will almost certainly come round and remove it. It doesn't mean he knows any more than you do about the laws of copyright. But nor, in my judgement, is it worth getting into a bleeping contest.

Hi Charles, in most cases you are correct, you can't simply copy a picture found on the web over to Wiki, but there are "fair use" exceptions. My main area of expertize is with bands and records, where I understand the fair use criteria. For example, if a band no longer exists, we can use a copyrighted photo under a "fair use" claim because a free picture is no longer possible. Likewise if a performer is deceased. I don't know if there are any "fair use" criteria that would apply to an old car that is no longer likely to be found. Back to photos that you find on the web, if the person who posted the picture is the person who took the picture, we can ask if they are willing to release the picture under a "creative commons" license. If they are willing, there's a fixed statement that we have to ask them to sign (electronically) which will allow the use of the picture at wiki. I posted the info about the French forum that I found, in case any French speaking editor wants to try contacting any of the people who posted pics of the 171 to get release statements from them. There's also the question of derivative works where, even if you take a picture yourself, you don't completely own the copyright because something in your picture is copyrighted. For example, you would not own the copyright in a photo that you took of a record sleeve or a painting. I don't know if an image of a car would be treated in a similar fashion, but I doubt it. I tried looking at the phedor site in your ref but it's blocked for me (on my work server) so I can't see what's there. I'll try and look at it when I'm at home.
