Lawsuit with CBS, win or lose?

Later, he was involved in a landmark lawsuit with CBS, for a 60 Minutes segment that painted him as a liar.[3] The charge stemmed from an appearance he made on the show, when host Mike Wallace surprised him by bringing one of his Army colleagues into the interview, who proceeded to deny the veracity of much of Herbert's story

At the supreme court level did he win or lose?

I read the external link and it is lawyer talk. In the book The Making of a Soldier it states that he won Herbert vs Lando.

Herbert speaks - interview archives

For those interested in Colonel Herbert's analysis of the Vietnam War and other interventions/invasions in the 1960s, Alternative Radio offers a number of interviews conducted by David Barsamian.

I owned all three of these interviews at one time; I highly recommend them, as they may be useful in improving the article.
