Keeping Families Together (Biden's policy)
Keeping Families Together is a United States immigration policy. The program was introduced by U.S. President Joe Biden on June 17, 2024. The program is specifically designed to provide a pathway to legal residency and eventual citizenship for undocumented spouses of U.S. citizens.[1] Sixteen US states, led by their Attorneys General, filed a lawsuit challenging the program’s legality, leading to a suspension of the program until the courts reaches a decision.[2]
Background
[edit]The initiative is modeled after the Deferred Action for Childhood Arrivals (DACA), initiated in 2012 under President Barack Obama.[3] DACA provides temporary protection from deportation and work authorization for certain individuals who arrived in the U.S. as children without legal documentation. Although former President Donald Trump attempted to end the program, the Supreme Court blocked this effort, allowing DACA to continue.[3]
Under President Joe Biden, rising migrant crossings at the U.S.-Mexico border have created pressure to find solutions.[4] In June 2024, his administration implemented a law to pause asylum processing at the border.[5] The Keeping Families Together program was introduced to help ease the pressure caused by the halt in asylum processing.[1]
Legal Challenges
[edit]The case is currently under review in the U.S. District Court for the Eastern District of Texas in Tyler, with a decision expected on November 8, 2024.[6]
