Not in the public domain?[edit]

This image was published in the "Japanese pictorial magazine about the Sino-Japanese War Asahi-ban Shina-jihen Gaho published on Jan. 27, 1938." according to the information provided in the information box. The page Talk:Nanjing Massacre denial/Disputed material has further images from that source and those other images have been uploaded to Wiki Commons. So, I'm a bit surprised to see the current license warning for this image. Is the source information for this image incorrect? Or were the other images from this source uploaded to wiki Commons despite not being in the public domain? Nakonana (talk) 14:17, 3 February 2024 (UTC)[reply]

Pinging @ShakespeareFan00, hi, I just noticed that the user who added the "wrong license" template to this file was your alternate account and that you seem to still be active with your main account.
Any chance you have any input on my above query? I'm just wondering if it would be safe to upload the file to Commons. I've also posted the above on Commons. @Nakonana: - You need to determine the US status. The logic is in {{PD-China}} which defaults to a wrong license tag if the US status isn't known. This was done to prevent the situation of images from Wikipedia being moved, deleted locally, and nuked on Commons for URAA concerns. @ShakespeareFan00 Thanks for your reply :). How do I determine it's copyright status in the US...? I'm not from the US. So far the people at Commons think it's fine to upload it to Commons and there are other images from the same source which are already on Commons. Nakonana (talk) 10:06, 30 June 2024 (UTC)[reply]
You need to find the author, and when they died typically, if it's less than 70 years ago, then the image cannot be transferred to commons. ShakespeareFan00 (talk) 10:16, 30 June 2024 (UTC)[reply]
