Contested deletion

This file should not be speedily deleted for having an invalid fair-use claim because the tags have been corrected, and the individual is now deceased. There is no longer an opportunity to create a free image, given the person's status and the risks associated with their criminal background. Requesting a free image from the family is not feasible due to these sensitivities. --Morogris () 02:04, 22 August 2024 (UTC)[reply]

    @Morogris: I don't think that addresses my concern here. The file's metadata says (AP Photo/McAllen Police Departmant) and Credit/Provider: AP. As WP:F7 states:

    Non-free images or media from a press agency or photo agency (e.g. Associated Press, Getty Images), where the file itself is not the subject of sourced commentary, are considered an invalid claim of fair use and fail the strict requirements of Wikipedia:Non-free content criteria, and may be deleted immediately.

    If the individual is deceased, that's relevant to WP:NFCC#1 (no free equivalent), but not to WP:NFCC#2 (respect for commercial opportunities):

    Note that if the image is from a press or photo agency (e.g., AP or Getty Images) and is not itself the subject of critical commentary it is assumed automatically to fail "respect for commercial opportunity".
