The use of this image in the article Follow the Girls qualifies under the fair use doctrine because:

  • it is a low resolution image;
  • its use will not deprive the copyright holder of income or opportunities;
  • it cannot be replaced by an equivalent free substitute; and
  • it is the primary visual representation of the musical that is the subject of the article, and so it adds substantially to the reader's understanding of the article.

  • It conveys crucial aspects of Block's early writing career. First, the style of the Broadway show and it's importance. Only top musicals or artistic endeavours would be worthy of a Hirschfeld cartoon. The drawing also shows the light and humorous aspect of musicals and thus why Block found employment from this form. This particular show is important as Block purchased shares in this show from the principal writer before the show became a hit and this is an early example of Block's working as producer and investor.
